A petition by Shawano Municipal Hospital, a judgment creditor of the estate, filed on the 20th day of April, 1950, prayed that Emil Reinke be required to account to the estate of Frederick Reinke, deceased, for the reasonable cost of care which Emil Reinke failed to furnish the deceased under a contract made by the said Emil Reinke with the said Frederick Reinke. In a statement of facts by petitioner it is related that in 1924 Frederick Reinke and Augusta Reinka, his wife, conveyed their farm and all personal property to their son Emil Reinke. The son, Emil Reinke, and his wife, Alvina, 'executed a Bond of Support to Frederick Reinke and Augusta Reinke in which they promised to give them board, room, and care for the rest of their lives.' There were other stipulations, such as, to 'pay certain designated children $3500 and to Frederick Reinke and Augusta Reinke the sum of $200 per year payable quarterly. Emil Reinke and Alvina Reinke at the same time executed a mortgage to Frederick Reinke in the amount of $7,000 to secure this Bond of Support.' As the result of this proceeding must turn on the question of the jurisdiction of the court, we confine the statement to the most essential facts going to that point.
