BEFORE: KENNEDY, MARTIN, and WELLFORD, Circuit Judges Order This appeal has been referred to a panel of the Court pursuant to Rule 9(a), Rules of the Sixth Circuit. Upon examination of the briefs and record, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. Plaintiff is appealing from an order denying his motion for relief from judgment filed pursuant to Rule 60(b), Federal Rules of Civil Procedure. The original judgment entered by the district court had dismissed plaintiff's civil rights action challenging the Ohio statutory scheme whereby inmates of a state reformatory receive earlier parole consideration than inmates placed in a penitentiary.
